OrthoSynetics, Inc. (“OSI”) respects the privacy interests of individuals with
regard to personally identifiable information that OSI collects. This Privacy
Policy outlines the information that OSI may receive from an affiliated
healthcare professional and how we will use that information. This statement
will also tell you how you can verify the accuracy of your personal information
and how you can request that we amend, correct or delete any information that
is inaccurate.
We have
developed our privacy policy from industry guidelines and standards, and
applicable legal requirements. This privacy policy is intended to comply with
the safe harbor created by the U.S. Department of

COLLECTED AND HOW WE USE IT
OSI’s primary goal in collecting personal information relating to a patient is
to enable your healthcare professional to have access to the information that
he or she needs for your effective treatment. OSI provides your healthcare
professional with computer systems that organize and process information
relating to you and your treatment. OSI also uses that information to provide
business and consulting services to your healthcare professional that in turn
helps the affiliated healthcare professional make your treatment experience
efficient. Your personal information will only be provided to your healthcare
professional for use in connection with your treatment and the operation of the
healthcare professional’s practice and will be used by OSI to provide its
consulting and business services to the affiliated healthcare practitioner.

Personal Information
To provide treatment to you, your healthcare
professional obtains information from and about you and transmits that
information to us, primarily through our proprietary computer systems. Besides
information relating to your treatment, this may include information
identifying who you are, such as your mailing address, as well as financial information
relating to your treatment. Additionally, we may use your personal information
to contact you. For example, we may send you correspondence related to
appointments, billing or follow-up care; we may respond to your comments or
requests for information; or we may contact you if needed in the course of or
after treatment.
We may also use personal information about you to improve our marketing and
promotional efforts and to improve our services. We may also use your
information to deliver information to you that, in some cases, is targeted to
your treatment, our services and promotions. We believe these uses allow us to
improve our services and better tailor them to meet your needs and the needs of
the affiliated healthcare provider.

OSI may include information about you and your treatment in the aggregate
information that we provide to the practice as part of the business and
consulting services that we provide to the healthcare professional.
If you visit one of our web sites, our web server will automatically recognize
some non-personal information, including but not limited to the date and time
you visited our site, the pages you visited, the referrer (the website you came
from), the type of browser you are using (e.g. Netscape, Internet Explorer),
the type of operating system you are using (e.g., Windows '95 or Mac OS), and
the domain name and address of your Internet service provider (e.g., AOL).
Neither the web log information nor cookies collects any personal information.
They do not contain personal information, such as your name or e-mail address,
and in no way are used to identify our users. OSI uses web log information
(such as your web browser, operating system, pages visited, etc.) to help us
design our website, to identify popular features, and for other managerial
purposes. However, web logs may be used if necessary to help identify any
person attempting to break into or damage our website. We may share web log
information with law enforcement agencies if we believe that we have evidence

perform for your healthcare professional or with OSI. These vendors,

than to provide services for your healthcare professional or with OSI, and they

activities as direct mailing, fulfillment services, or e-mail campaigns.
OSI may share your information with any person or company that acquires the OSI business or any portion of the OSI business to which your information relates. OSI will ensure that any person or company to which your information is transferred agrees to abide by the same privacy obligations as OSI. OSI also reserves the right to share the information to respond to duly authorized information requests of governmental authorities or where required by law.
